Agreement
These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "User") and Yotton Team ("we", "us", or "our") governing your access to and use of the Yotton mobile application and related services (collectively, the "App" or "Services").
By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) The Services
Yotton is a DIY tutorial and creation tool that helps you capture photos, write instructions, organize projects, and export or share multi-page guides.
2) Eligibility
You must be at least 17 years old to use the Services. By using the Services, you represent that you meet this requirement.
3) Account Registration and Security
You may need an account to use certain features. You agree to provide accurate information and keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us promptly if you suspect unauthorized access.
4) Your Content
4.1 Definition
"Content" means any text, photos, images, instructions, project details, comments, and other materials you create, upload, import, or share through the Services.
4.2 Ownership
You retain ownership of your Content. These Terms do not transfer any ownership rights in your Content to us.
4.3 License to Operate the Services
You grant Yotton Team a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display your Content solely to operate and provide the Services
(for example, to save your projects, generate exports you request, and enable sharing you initiate).
4.4 Your Responsibility
You are responsible for your Content and represent that you have all rights necessary to submit it and to grant the license above.
4.5 Content Removal
You can delete your Content by using features in the App (where available) or by deleting your account. We may remove or restrict access to Content if we reasonably believe it violates these Terms or applicable law.
5) Acceptable Use
You agree not to:
- violate any applicable law or regulation;
- infringe intellectual property or privacy rights;
- upload malware, attempt unauthorized access, or interfere with the Services;
- reverse engineer, decompile, or attempt to extract source code except where prohibited by law;
- use the Services to harass, threaten, or harm others;
- scrape, crawl, or collect data from the Services in an automated manner without our permission; or
- use the Services in a manner that could impair the integrity, performance, or security of the Services.
6) Privacy
Your use of the Services is also governed by our Privacy Policy. Please review it to understand how we collect and use information.
7) Intellectual Property
The Services, including the software, design, logos, and other materials (excluding your Content), are owned by Yotton Team and protected by applicable intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms.
8) Third-Party Services
The Services may interact with third-party services (for example, platform services or analytics). Your use of third-party services is governed by their terms and policies. We are not responsible for third-party services.
9) Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that any content will be preserved without loss.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOTTON TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOTTON TEAM’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $10, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11) Indemnification
You agree to defend, indemnify, and hold harmless Yotton Team from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your Content, your use of the Services, or your violation of these Terms.
12) Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services if we reasonably believe you have violated these Terms or if required to protect the Services or other users.
Upon termination, your license to use the Services ends. Sections that by their nature should survive will survive termination, including sections on ownership, disclaimers, limitation of liability, indemnification, and dispute resolution.
13) Changes to the Services or Terms
We may modify the Services and these Terms from time to time. If we make material changes, we will provide notice through the App or by other appropriate means. Continued use of the Services after changes become effective means you accept the updated Terms.
14) Governing Law and Dispute Resolution (Binding Arbitration)
Governing law: These Terms are governed by the laws of the jurisdiction where Yotton Team’s principal place of business is located, excluding conflict of law rules.
Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration, except that either party may seek injunctive or equitable relief for unauthorized use of intellectual property or to protect rights and property.
The arbitration will be conducted in English by a neutral arbitrator, and the decision will be final and binding.
